In a groundbreaking move, Cuba has enacted Law 179 of the Cuban Sports System, marking the first comprehensive legislation of its kind in the country's history. This law will allow foreign economic entities to engage in the sponsorship and funding of sports within the island, commencing on May 13, 2026, the law's effective date.

The legislation received approval from the National Assembly of People's Power in July 2025 and was subsequently published in the Ordinary Official Gazette No. 3 on January 13, 2026.

Comprising 5 titles, 26 chapters, and 253 articles, the law establishes the legal framework for the operation of the Cuban Sports System. For the first time, it includes both state and non-state economic entities, whether domestic or foreign.

Opening Doors for Foreign Participation

Karel Luis Pachot Zambrana, the legal director of INDER, informed Prensa Latina that "the status of being national or foreign does not restrict participation in sponsorship activities within the island's sports sector."

According to Pachot, these contributions "extend beyond mere financial support to include the production of goods, service provision, and innovation and development of knowledge, aimed at strengthening the sports system as a socially beneficial entity."

Regulations and Challenges Ahead

The authorization process is governed by INDER's Resolution 41 of 2025. Interested economic actors must submit their proposals to a federation or organizing committee, which are then evaluated and approved based on the event's level.

Pachot Zambrana acknowledged that a key challenge will be "enhancing the preparation and understanding of all parties involved in the advertising and sponsorship authorization processes."

Federative Autonomy and Athlete Selection

Another significant change is the federations' autonomy in selecting athletes. Article 156 grants national sports federations exclusive authority to choose athletes and technical staff without requiring permanent residency in Cuba.

This provision allows Cuban expatriates to join national teams, albeit with conditions: adherence to international federations' eligibility criteria and alignment with the principles of the Cuban Sports System.

A Response to Sports and Economic Collapse

The law arrives amid a sports crisis in Cuba in 2025. That year, 41 baseball players signed with Major League organizations, INDER indefinitely suspended competitions in various disciplines due to fuel shortages, and Cuba withdrew from the AmeriCup basketball tournament in February after visa denials to 14 out of 17 players and coaches.

Additionally, Cuba's GDP plummeted by 5% in 2025, adding to a cumulative 15% decline since 2020.

Implications of Foreign Sponsorship

The move towards foreign sponsorship is part of a broader trend: in March 2026, the regime announced that expatriates could invest directly in sectors such as tourism, infrastructure, and energy.

However, experts caution against the lack of rule of law and genuine legal protections for investors. Notably, the case of a foreign investor imprisoned in Cuba has reignited concerns about the true risks of entering the Cuban market, where regulations may shift unpredictably without effective legal safeguards.

Pachot Zambrana emphasized that the State "remains the primary guarantor of sports resources on the island," and the model continues to align with the country's socialist economic and social system, raising questions about the actual extent of the announced opening.
