elTOQUE reported that the 23-year-old was apprehended on January 14, 2026, at his home in Havana. His arrest followed live broadcasts on Facebook where he advocated for political reform in Cuba and directly addressed U.S. President Donald Trump.

Just days before his arrest, Guerra Fis had celebrated the fall of Nicolás Maduro in Venezuela and urged Trump to resolve the ongoing situation in Cuba. In one of his live sessions, he claimed a dictatorship had fallen and suggested that Cuba was next, expressing optimism for imminent change.

News of his prison transfer came after journalist José Luis Tan reported that judicial authorities dismissed the special habeas corpus procedure filed against his detention. The dismissal effectively closed one of the legal avenues pursued by his family.

Guerra Fis faces charges of propaganda against constitutional order, a charge introduced in the Penal Code since December 2022, which carries a sentence of four to ten years in prison for using platforms, including digital spaces, to disseminate messages deemed contrary to the socialist state or social order.
