In a case that captured international attention, Jorge Gabriel Morales, who abducted his six-year-old autistic son in 2022 and took him to Canada, appeared in court this week to request the dismissal of the kidnapping charges against him. Jay White, his defense attorney, stated that Morales is deeply distressed. According to White, while Morales acknowledges his wrongdoing, he insists that his actions were driven by love for his son. He admits to taking the child for the wrong reasons but thought he was helping him.

White further argued that Morales had the right to take his son but failed to return him to his mother, which escalated the situation. He contended that this case should not be considered a kidnapping and expressed hope for Morales' release. Nevertheless, the judge denied the request after hearing the arguments presented.

Background of the Case

The case came to light in August 2022, when Yanet Concepción, a Cuban mother, pleaded for the return of her son, Jorge "Jojo" Morales, who had been taken by his father. On Saturday, August 27, Jorge Gabriel Morales picked up the boy from his maternal grandmother's house and never brought him back. Authorities initially suspected the involvement of the boy's paternal grandmother, Lilliam Peña Morales.

By mid-October, the Federal Bureau of Investigations (FBI) offered a $10,000 reward for information leading to the child's whereabouts. “There were letters indicating an intention not to return and a desire for no one to ever see the child again,” Yanet Concepción revealed to Telemundo 51.

After an exhaustive search spanning two months, authorities finally located the child in a Walmart in Canada with his father and paternal grandmother. The child was returned to the United States, resulting in an emotional reunion with his mother in Miami.

Now eight years old, the boy is attempting to regain a sense of normalcy in his life, despite the trauma he endured. “He looked at me and said, 'My dad is a bad person' after browsing the internet. I told him that everyone makes mistakes, and after we pay for them, we seek forgiveness from God, as we are all His children,” recounted his mother.

A Mother's Pursuit of Justice

Yanet Concepción believes her ex-husband should not be released. “I am not vengeful nor do I seek maximum punishment out of spite. I simply feel that until my son is an adult and no longer needs my protection, I would not feel safe with that person free,” she asserted.

If the prosecution does not present a favorable deal, Morales may face a trial where a jury will decide if his actions qualify as kidnapping. A guilty verdict could result in a life sentence. Earlier this year, Lilliam Morales, Jojo's paternal grandmother, reached an agreement with the prosecution, allowing her to avoid kidnapping charges and live freely under ten years of probation.
