The new Migration Law project published by the National Assembly of People's Power (ANPP) on Monday introduces a provision that grants Cuban victims of human trafficking the right to family reunification in Cuba.

According to the document, similar to the Law No. 1312, "Migration Law" dated September 20, 1976, human trafficking activities are internationally prosecuted and may result in inadmissibility and potential deportation from the territory.

Moreover, the law also imposes fines and administrative sanctions on companies that violate immigration regulations, including those that might indirectly facilitate human trafficking.

An important aspect of the project presented by the ANPP is that it allows Cubans who have been victims of such crimes to exercise their right to family reunification and return to the country on their own terms, with the support of international bodies or organizations.

The document clarifies that such requests can be submitted to a nearby Cuban consulate or office, which is expected to provide support. Additionally, if the individual is abroad, the migration authority will immediately notify their family in Cuba and facilitate communication between them.

The Migration Authority will take prioritized actions within its scope of competence to offer special attention, especially to minors. For the repatriation of a human trafficking victim, international organizations or entities addressing these issues may be involved, as indicated in the document.

It is crucial that individuals who wish to exercise their right to family reunification, having been victims of human trafficking, provide informed consent at the appropriate consulate. Foreign nationals in this situation can apply for residency in Cuba under the humanitarian resident classification.

The law project also emphasizes the significance of international cooperation in combating human trafficking, highlighting the state’s commitment to adopting adequate preventive and punitive measures against this practice.

Additionally, on Monday, the ANPP published the Immigration Legislative Project. According to the government, the objective of releasing these law projects is to "promote citizen participation and contribute to the legal culture" of Cubans.
